In a bitter and highly charged confrontation, Robert Aquilina, the President of Repubblika, has launched a fierce attack on Magistrate Nadine Sant Lia. This escalation follows Sant Lia’s decision to order an investigation into Aquilina, following the illegal leakage of sensitive information related to an ongoing inquiry.

The case at hand revolved around a legal challenge brought by Nationalist Party Deputy Karol Aquilina against the Police Commissioner, who, according to the complaint, had failed to prosecute individuals connected to the Pilatus Bank amidst a money laundering investigation. Magistrate Sant Lia’s ruling concluded that illegal leaks had tainted the judicial process, a move that would trigger an investigation into how such breaches occurred, including allegations against Robert Aquilina himself.

The Magistrate’s judgment was scathing, noting that Aquilina had based his testimony on hearsay and had failed to disclose the identities of individuals who had allegedly provided him with information unlawfully. This is a direct challenge to Aquilina’s credibility and the integrity of his actions. In light of these revelations, Sant Lia ordered an investigation into the matter, leading to further tensions when Aquilina, hours after the ruling, appeared at the Police Depot in Floriana alongside Jason Azzopardi to openly criticise the Magistrate and other state institutions.

Aquilina’s response was nothing short of inflammatory. He branded the Magistrate’s ruling as a “perversion of justice,” challenging the legal reasoning behind the judgment and attacking the judicial process. He rejected the idea that his actions were based on hearsay, which had been cited in the court ruling, and suggested that the allegations were nothing but lies. His behaviour points to a pattern within certain factions of the Nationalist Party, where judicial decisions are only accepted when they align with their interests. When the verdict does not suit them, they resort to vilification and delegitimisation of the institutions involved.

This is not the first instance of such attacks. The Nationalist Party, in alliance with Robert Aquilina and Repubblika, has consistently targeted state institutions whenever they encounter legal rulings or investigations that do not align with their narrative. The rhetoric employed is divisive and destructive, undermining public trust in the very judicial structures designed to maintain order and fairness. Aquilina’s attacks on the Police Commissioner, alongside his verbal sparring with Magistrate Sant Lia, expose a disturbing disregard for the rule of law.

Further revelations have come to light in court, revealing that Aquilina possessed information that he should not have had access to. Magistrate Sant Lia noted that these leaks likely came from within the Financial Crime Investigation Department (FCID), specifically from the disgraced former Superintendent Frank Anthony Tabone. Tabone, a known ally of Jason Azzopardi and a candidate for the Nationalist Party in the upcoming election, raises serious questions about the intertwining of politics, law enforcement, and judicial integrity.

Prime Minister Robert Abela condemned the attacks on the judiciary, describing them as “unacceptable in a democratic society.” He particularly called out the “extremist wing” of the Nationalist Party, accusing them of abusing the judicial process for their own political gains. According to Abela, the Nationalist Party’s response to the court’s decision was less about justice and more about an attempt to manipulate the system for personal and political advantage.

Abela’s words were a clear message to those in the Nationalist Party attempting to undermine the justice system: “This is not justice they seek, but persecution. And when their deceit is exposed, they resort to intimidation, hoping to silence those who hold them accountable.”

Robert Aquilina’s relentless attacks on Magistrate Sant Lia and the judiciary are not merely isolated incidents of defiance. They reflect a broader, more dangerous agenda to weaken state institutions that refuse to conform to the political whims of those in power. Such actions have profound implications for the rule of law in Malta, and it is imperative that the public stands firm against these attempts to erode the independence and integrity of the justice system.
